Judge dismisses part of New Jersey lawsuit stemming from 2012 rail derailment, chemical leak
A federal judge has thrown out part of a lawsuit stemming from a 2012 train derailment that leaked hazardous chemicals in southern New Jersey.
The ruling published Tuesday dismisses some claims against CSX and Norfolk Southern, two rail companies connected to Conrail.
Seven cars on a train operated by Conrail derailed in Paulsboro on Nov. 30, 2012. Vinyl chloride, a gas linked to respiratory problems, dizziness and death, was released.
Numerous residents sued Conrail. Some sued CSX and Norfolk Southern, claiming the companies were liable since they took over some operations from Conrail in the late 1990s.
The judge noted in Tuesday's ruling that the bridge, train and crew involved in the 2012 accident were operated or employed by Conrail.
A trial is scheduled for next month.
